Party Wall Compliance

The Party Wall Act 1996 was introduced in England and Wales to provide a framework for preventing and resolving disputes in relation to party walls, party structures, boundary walls and excavations near to neighbouring buildings.

Elvet Chartered Surveyors' building surveyors are professional, unbiased and resolute in providing expert advice to both Building Owners (Developers) and Adjoining Owners, to ensure both parties are conscious of their rights and obligations under the Act.

Many of the north-east's largest social housing providers and independent landlords entrust Elvet Chartered Surveyors to manage their affairs in relation to Party Wall matters, which is testament to the confidence they bestow in our knowledge, experience and client care.

Acting on behalf of the Building Owner (Developer) Elvet will:

  • Advise the Building Owner (Developer) of their rights and obligations under the Party Wall Act 1996.
  • Confirm which works are notifiable within the scope of the Act.
  • Prepare and serve a formal Party Wall Notice on the Adjoining Owner(s).
  • Produce an accurate schedule of condition to protect all parties.
  • Prepare and serve the Party Wall Award.
  • Liaise with the Adjoining Owners appointed surveyor as necessary.
  • Amicably resolve any issues relating to damage or compensation.

Acting on behalf of the Adjoining Owner (Neighbour) Elvet will:

  • Where necessary prepare a counter notice setting out what additional or modified works are required.
  • Implement appropriate measures to protect the Adjoining Owners property from foreseeable damage or works that will compromise their security.
  • Agree when and how the works will be undertaken to remove any unnecessary inconvenience.
  • Negotiate the terms of the Party Wall Award as necessary; and
  • Agree compensation and damages when unforeseen events occur.
